This privacy notice for the Learning Technology Center (“LTC,” “we,” “us,” or “our”) describes how and why we might collect, store, use, and/or share (“process”) your information when you use K12Smart Services (“service”, “services”). K12Smart is a suite of online tools designed to streamline educational operations. By using the service, you agree to the collection and use of information in accordance with this policy.

What Information Do We Collect?

Personal Information You Disclose to Us

We collect personal and confidential information that users voluntarily provide when registering for the service, as well as information provided about users by their organization. Participation in activities on the service, uploading documents or data, and communications with us are also collected and stored by us and our subprocessors. The personal and confidential information we collect may include the following:

Organization
Authentication Data
Other data optionally provided through your account or by your administrator

Information Automatically Collected

We automatically collect certain information when you visit, use, or navigate the Service. This information may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country location, and other technical information.

This information is primarily needed to maintain the security and operation of the Service and for our internal analytics and reporting purposes. The information we collect includes:

Log and Usage Data: Service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use the Service.
Device Data: Information about your computer, phone, tablet, or other device you use to access the Service, such as your IP address, device and application identification numbers, browser type, hardware model, and operating system.
Location Data: Information about your device’s location, which can be either precise or imprecise. You can opt out of allowing us to collect this information by disabling your location settings on your device.

We process your personal and confidential information for various reasons, depending on how you interact with our Service, including:

To deliver and facilitate the delivery of services to users or on behalf of an organization: We may process your information, including confidential documents and data, to provide you with the requested service.
To respond to user inquiries/offer support to users: We may process your information to respond to your inquiries and solve any potential issues you might have with the requested service.
To send administrative information to you: We may process your information to send you details about our products and services, changes to our terms and policies, and other similar information.

When Do We Share Your Information?

We may need to share your personal and confidential information in the following situations:

Account Holders: Primary Accounts and their K12Smart administrators can request an organizational data export at any time.
Service Providers: We may share your information with third-party service providers who perform services on our behalf, such as hosting, data analysis, and customer service.
Other Users: When you share personal or confidential information (for example, by posting comments or uploading documents), such information may be viewed by authorized users within your organization or region, depending on the access controls you set.
Legal Requests: We may be required to provide information about accounts and users in accordance with local, state, and federal law.

We may need to share anonymized (non-identifiable) information in the following situations:

Reporting Organizational Performance: When talking to organizations that provide us funding or govern our work, we may share anonymized data and statistics about platform usage and demographic information about organizations and users who have accounts on the platform.
Marketing: We may share information such as, but not limited to: Total number of accounts, total number of users, total number of paying subscribers, total number of specific actions taken on the platform.

Do We Use Cookies or Other Tracking Technologies?

We may use cookies and similar tracking technologies to access or store information. Specific information about how we use such technologies and how you can refuse certain cookies is set out in our Cookie Notice.

How Long Do We Keep Your Information?

We keep your personal and confidential information for as long as necessary for the purposes set out in this privacy notice unless a longer retention period is required, requested, or permitted by law.

How Do We Keep Your Information Safe?

We have established appropriate and reasonable technical and organizational security measures aimed at safeguarding the personal and confidential information we handle. Nevertheless, it is important to note that while we strive to protect your information, no electronic transmission over the internet or data storage technology can be guaranteed as entirely secure. Therefore, we cannot assure or warrant that unauthorized third parties will not be able to breach our security measures and improperly collect, access, steal, or alter your information. In the unlikely event of a breach, users will be promptly notified.

Do We Collect Information From Minors?

We do not knowingly solicit data from or market to children under 18 years of age. Personally identifiable information from or pertaining to unauthorized users under 18 is not allowed to be stored on our platforms.

What Are Your Privacy Rights?

You have certain rights regarding your personal and confidential information, including the right to access, correct, or delete your information. Account administrators are able to submit these requests for themselves, their organizations, and for users they support. Please submit these requests to support@k12smart.com.

Do We Make Updates to This Notice?

We may update this privacy notice from time to time. The updated version will be indicated by an updated “Revised” date, and the updated version will be effective as soon as it is accessible. When updates are made to this our terms, account administrators will be notified when the policy is published.
